Criminal Court Cases in McDowell County
McDowell County criminal cases do not all begin and end in one court. Magistrate Court hears misdemeanors, issues warrants, sets bail, and conducts preliminary felony proceedings. A misdemeanor may stay there through plea or trial and sentence. A felony can move onward after a preliminary examination, waiver, or grand-jury action. The McDowell County Circuit Court then handles the felony indictment, arraignment, motions, plea or trial, judgment, sentence, and any post-judgment filings within its authority.
The West Virginia Judiciary's McDowell County directory identifies each clerk and court location. Circuit Clerk Francine Spencer keeps Circuit Court files at 90 Wyoming Street, Suite 201, Welch, WV 24801, and can be reached at 304-436-8535. Magistrate Clerk Andrea Fowler keeps the lower-court files at 105 Wyoming Street and can be reached at 304-436-8587. Municipal ordinance cases may remain with a city court, so neither county search necessarily covers every local citation.
McDowell County Felonies in WVPASS
The Judiciary's March 2025 WVPASS launch notice marked the move of modern McDowell County Circuit Court access online. The service covers public circuit documents from all 55 counties dating to 1999. Registration is free. Public users can search case metadata and pay a small document-download charge, though the official material reviewed for McDowell County did not state one universal per-document price. Search by case number when possible. A party name, county, case type, and date range can narrow a common-name result.
WVPASS is a circuit portal, not a full criminal-history repository. A result can show the case number, court, case style, filing date, status, parties, docket entries, and links to public documents. It does not turn a pending charge into a conviction. It also cannot display sealed, juvenile, victim-sensitive, or otherwise confidential material. A felony complaint may appear first under a Magistrate Court number, then later under a different Circuit Court number after indictment. Save both numbers when tracing the whole McDowell County case.
McDowell County Case Record Searches
Start with the court that handled the stage in question. The Judiciary's Magistrate Record Search instructions lead to complaints, misdemeanors, bail events, and early felony proceedings. Use WVPASS for a later felony case in Circuit Court. The Magistrate search is free, returns no more than 30 results, and does not supply document images. WVPASS supplies public circuit documents from 1999 onward. Older, certified, or absent material must come from the proper McDowell County clerk.
- Choose Magistrate Search for a misdemeanor or the first court stage of a felony. Choose WVPASS for a Circuit felony.
- Enter the case number if known. Otherwise, search a party name and select McDowell County.
- Use case type, filing date, and spelling variants to separate close name matches.
- Read the status and docket in order. Note each case number when a felony moves between courts.
- Call the correct clerk for the public document, certified copy, archived file, or current copy fee.
| Search field | System | Required | Use |
|---|---|---|---|
| First or last name | Both | No | Use spelling variants and another identifier |
| Case number | Both | No | Best exact route when known |
| County | Both | No | Select McDowell to reduce statewide noise |
| Case type | WVPASS | No | Limit results to the relevant public category |
| Date range | WVPASS | No | Separates similar names and filing periods |
The two systems expose different controls because they serve different courts. Magistrate Search accepts a first or last name and limits the result set. WVPASS adds circuit filters and public document links for registered users. Neither search promises a date-of-birth field, so do not invent one or use a name alone as proof of identity. When an entry is unclear, the case number and McDowell County clerk are the safest next checks.
McDowell County's Two-Number Case Trail
One arrest can produce two McDowell County criminal case numbers. A sworn complaint begins a Magistrate Court matter. The first appearance and bail decision occur there. If the allegation is a felony, a preliminary examination or waiver may follow. A grand jury can later return an indictment in Circuit Court, where a new docket tracks the felony prosecution. Searching only WVPASS can miss the lower-court beginning. Searching only the Magistrate index can miss the later judgment and sentence.
Match the records by more than a name. Compare the filing sequence, charge text, arresting agency, and dates. A charge may also change between the complaint and indictment. That change is not an error by itself. Prosecutors decide what charge to pursue, and the court record documents the result. The full McDowell County arrest search explains the separate agency and booking records that may precede either court file.
Note: A Magistrate case number and Circuit case number may describe different stages of the same alleged conduct.
What a Criminal Case File Contains
A McDowell County criminal case file is a procedural record. It identifies what the state filed, what happened in court, and how each charge was resolved. The docket is the event list, while the complaint, indictment, motion, plea order, judgment, and sentencing order provide the substance. Read the actual disposition document before drawing a conclusion from a status label. “Dismissed” means the charge ended without a conviction in that case. “Pending” means there is no final outcome yet.
| Case number and court | Identifies the docket and whether Magistrate or Circuit Court holds it. |
|---|---|
| Charging document | A complaint starts a Magistrate matter; an indictment is a grand jury's felony accusation. |
| Docket entries | Lists filed papers, hearings, pleas, orders, and other public events by date. |
| Hearing details | May identify the judge, attorneys, hearing type, and public schedule information. |
| Disposition and judgment | Shows whether a charge was convicted, dismissed, acquitted, or otherwise resolved. |
| Sentence and conditions | Records the court's sentence, including public probation or custody terms where stated. |
The most useful paper depends on the question. Use the charging document to see the formal accusation, the docket to map events, the judgment to confirm the outcome, and the sentencing order to verify the court's terms. Financial assessments may appear in clerk records but are not assured in a public index. Counsel and judge names can be public, while personal identifiers and protected addresses should not appear in the public McDowell County view.
McDowell County Cases Before 1999
WVPASS coverage begins with public Circuit Court documents dating to 1999. That boundary does not mean an older McDowell County case never existed. Paper files and older indexes may require clerk retrieval. Give the Circuit Clerk the closest known case number, party spelling, charge, and year. Advance notice helps staff locate an archived file. Ask whether inspection, a plain copy, or a certified copy best fits the need, and request the current fee before ordering because no dependable McDowell County copy schedule was found in the official source set.
The same direct-contact rule applies when a current result lacks a document. Magistrate Search is an index only, so Andrea Fowler's counter supplies public lower-court papers. The official Circuit Clerk procedural manual allows oral or written inspection requests, with staff retrieving the file for review in a designated area. A missing online page may reflect age, digitization limits, confidentiality, or a search in the wrong court. It is not proof that the McDowell County record was destroyed or expunged.
Criminal Case Stages in McDowell County
A McDowell County case starts with a complaint or arrest record, but the filed court charge controls the judicial track. Magistrate Court handles the initial appearance and bail. A misdemeanor may proceed to plea or trial there. A felony moves toward grand-jury review and Circuit Court. Circuit stages can include arraignment, discovery, pretrial motions, a negotiated plea or trial, judgment, sentencing, and appeal. No fixed local duration applies to every case because the charge, motions, custody status, and court schedule differ.
Case flow: Charges Filed › Arraignment › Pretrial › Plea or Trial › Disposition › Sentencing
The terms mark distinct events. An arraignment is the hearing where a charge is formally presented and a plea is taken. A disposition is the outcome of a charge. A sentence is the consequence imposed after a conviction. Keeping these events separate prevents a docket entry from being mistaken for the final McDowell County judgment.
McDowell County Adult Drug Court Records
The McDowell County Adult Drug Court, established in 2015, is a named treatment-court pathway. It is not a separate public record repository. The underlying criminal matter remains a court case, and public orders or docket events remain with the Circuit Clerk. Treatment details, assessment material, and probation work notes may be restricted even when the docket shows participation or a public order.
Read the case file to learn what the judge ordered and how the charge was resolved. McDowell County Probation at 85 Wyoming Street supervises local court matters, but it is not a public probationer search service. A treatment-court path also does not erase the arrest cycle on its own. If a case later qualifies for expungement, the person must use the statutory court process and track the order through the Circuit Clerk.
The West Virginia conviction-expungement statute shows the rules that can affect eligible court records.
The statute image reinforces why an outcome and later record relief must be checked in the official McDowell County court file.
Federal McDowell Cases Use PACER
McDowell County also has a federal layer because FCI McDowell sits near Welch. A prosecution arising at that institution does not become a West Virginia Circuit Court case merely because the conduct occurred in the county. Federal dockets belong in PACER through the U.S. District Court for the Southern District of West Virginia. The U.S. Attorney's Office for the Southern District prosecutes federal matters. State custody appears in WVDCR OIS, while federal custody is checked through the Bureau of Prisons.
The Bureau of Prisons Inmate Locator is the official federal custody channel.
A locator result can establish federal placement, but PACER remains the source for the federal complaint, docket, judgment, and sentence.
Access Rules for Case Records
Public access does not make every detail visible. West Virginia Trial Court Rule 15A.26 preserves public access to electronic trial-court records while protecting sealed and private material. The Judiciary's CourtPLUS overview explains the circuit and family e-filing system behind that access. McDowell County public views can omit juvenile files, sealed matters, victim-sensitive data, Social Security and financial-account numbers, precise protected addresses, and confidential filings.
A court file and a WVSP rap sheet serve different purposes. The file holds pleadings and judicial events. The state repository pairs fingerprint-linked arrest cycles with reported outcomes, and private dissemination requires the subject's signed and acknowledged authorization under W. Va. Code §15-2-24(d). For a suspected error, obtain the certified McDowell County disposition first. That document gives the clerk or repository a firm basis to review the result.
